I refer to the decision of the Commissioner for Environmental Information (Ref: OCE- 125751-P6M5Y9) dated 13th December 2024 and the direction by the Commissioner in his Decision to the EPA to release the information sought.
In accordance with Article 13(1) of the AIE Regulations, a party to an appeal under article 12 or any other person affected by the decision of the Commissioner may appeal to the High Court on a point of law from the decision.
Having considered the Commissioner’s direction, the EPA has decided not to appeal to the High Court. The EPA will carry out the Commissioner’s direction dated 13th December 2024 and release the information sought subject to the following caveat which should be included in any reproduced copies of the information released:
