I made a decision on your request on 15/02/2023. Following examination of material held by the Department of the Environment, Climate and Communications, I have been unable to locate any records relevant to your request. I therefore refuse your request


With regards to specific questions raised by you:

  1. Any data audits conducted by or for DECC to identify environmental datasets under the Open Data Directive?
    No audits to identify environmental datasets under the Open Data Directive have been
    conducted by or within DECC. At present DECC does not “hold” any environmental
    datasets of its own and relies instead on environmental datasets produced mainly by other
    state bodies and agencies as well as other sources.
  2. Directive 2019/1024/EU introduces the concept of high value datasets (HVDs). Please list any HVDs identified by DECC
    As DECC Data Officer I have not been notified of any list of environmental HVDs identified
    by DECC.
  3. Under Regulation 4 of SI 376/2021 all Departments/Offices and relevant bodies under their aegis are obliged to supply to the Minister for Public Expenditure and Reform with information as requested from time to time, such as open data progress reports. Provide copies of the DECC progress reports as supplied to PER.
    This is not environmental information as defined by SI 133/2007; “environmental
    information” means any information in written, visual, aural, electronic or any other material

    I’m the officially appointed DECC Data Officer and I have not been notified of any exclusive
    arrangements agreed to date by DECC

  1. Any exemptions sought by DECC to the release of open data, and which datasets these exemptions related to.
    No exemptions to the release of open data have been sought by DECC or from anybody
    within DECC.
  2. Public Bodies must draft an Open Data Publication Plan. Provide a copy of any DECC draft or completed open data plans to date
    This request is not related to environmental data. Public Bodies are not required to submit a publication plan of environmental information and none has been submitted by DECC to date.
  3. All public bodies need to publish details of what data is available for re-use and the licencing conditions that apply (CC BY 4.0 Attribution advised). Please provide a list of (where this differs from data audit list, see above).
    Public bodies have published 3,542 datasets under the Environmental theme on the open
    data portal (https://data.gov.ie/dataset?theme=Environment). This is the only list of
    environmental data available for reuse to which DECC Data Officer and other personnel
    have access.
  4. Copy of DECC’s RPSI Policy (RPSI is Reuse of Public Sector Information)
    To date, DECC has not developed an RPSI Policy and consequently does not have an
    RPSI Policy document.

I have also been unable to determine whether any other public authority might possess the
records that you have requested.

Open Data Directive: when could we see open data implementation in Ireland?

20 January 2023, EU Commission published a list of high-value datasets that public sector bodies will have to make available for re-use, free of charge, within 16 months. So that would be May 2024

The focus is on data with important benefits for society, the environment and the economy – which is why they should be made available to the public

The Regulation is set up under the Open Data Directive, which defines six categories of such high-value datasets: geospatial, earth observation and environment, meteorological, statistics, companies and mobility. This thematic range can be extended at a later stage to reflect technological and market developments.

The datasets will be available in machine-readable format, via an Application Programming Interface and, where relevant, as bulk download.

Public sector bodies shall designate a point of contact for questions and issues related to the API with a view to ensure the availability and maintenance of the API and ultimately the smooth and effective publication of the high-value datasets.

By 2 years after entry into force of this Implementing Regulation Member States shall provide the Commission with a report on the measures they have carried out to implement this Implementing Regulation.

DAFM Open Data Strategy

  1. Any data audits conducted by or for DAFM to identify environmental datasets under the Open Data Directive:
    The department is currently in the process of assessing data sets to publish in line with the Open Data Directive, however, please note that the identification of environmental specific datasets was not part of this process.
  2. Directive 2019/1024/EU introduces the concept of high value datasets (HVDs).  Please list any HVDs identified by DAFM.
    Under the inspire directive DAFM in collaborations with partners in the Ordnance Survey Ireland (OSI), Environmental Protection Agency (EPA), Department of Housing, Local Government and Heritage, Central Statistics Office (CSO), Geological Survey Ireland, Marine Institute, Property Registration Authority, Met Éireann and Teagasc have made available a suite of datasets available that have previously been identified as High Value Datasets under the Open Data thematic areas. DAFM specific datasets include Poultry Holdings, Single Farm Payment System Parcels, Forestry Plantations, LPIS and GSAA. https://inspire.geohive.ie/geoportal/#searchPanel

    I am to advise that the EPA has not identified any HVDs to date, therefore the records do not exist.

    I am to advise that the EPA has not completed any Open Data Publication Plans to date, therefore the records does not exist.

  • Please note that the EPA is currently undertaking a project to scope their Shared Data Management Programme which will set priorities and initiatives for the EPA going forward in Open Data.

The programme will cover areas such as a Data Audit and include the development and publication Open Data Publication Plan.

    The first Open Data Request Progress report was submitted last year to the Department of Public Expenditure and Reform (DPER). Please see EPA’s Open Data Progress Report attached.

OPW Open Data Strategy

Under the AIE Regs to request the following records in relation to OPW compliance with the Open Data Directive.

1.       Any data audits conducted by or for OPW to identify environmental datasets under the Open Data Directive

a.       The Flood Risk Management programme has carried out an audit of datasets and developed a Data Release Policy and Data Catalogue with metadata for each dataset.  This is currently in use internally and it is planned to make a subset of the data available externally for open access. In the meantime, a full list of Flood Risk Management related spatial datasets and their applicable release policy and licences are available to view on https://www.floodinfo.ie/contact/ See also Schedule of Documents for a direct link.

b.       No audits have been carried out in the Estate Management Programme and in Corporate Services.

2.       Directive 2019/1024/EU introduces the concept of high value datasets (HVDs).  Please list any HVDs identified by OPW

a.       The EU Commission has recently published an Implementing Regulation relating to High Value Datasets on 21st December 2022.  [The] Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union. It shall apply from 16 months after entry into force of this Regulation. a.       A full list of Flood Risk Management related spatial datasets and their applicable release policy and licences are available to view on https://www.floodinfo.ie/contact/ . Many datasets are published under the CC-BY license, however some Flood related data published via www.floodinfo.ie are licensed under the CC-BY-NC-ND license  https://creativecommons.org/licenses/by-nc-nd/2.0/legalcode because of their commercial sensitivity. This data shows risk at community level. Individual property owners and occupiers could be significantly disadvantaged by the release of this data through loss of access to financial services (e.g. Insurance and Mortgage Credit).

7.       Public Bodies must draft an Open Data Publication Plan. Provide a copy of any OPW draft or completed open data plans to date

a.       See Flood Risk Management Data Policy, noting that it is the OPW’s policy to publish on the internet much of the data that it creates and collects in relation to Flood Risk Management as a matter of routine. Technical solutions are continuously reviewed and implemented to provide direct access to the data, where licenses permit.

h.       The National Botanic Gardens make a number of datasets available on their website: http://botanicgardens.ie We conduct research and gather information on our collections on various databases. We already have our living collection lists on our website along with previous publications concerning the contents of the herbarium (dried plant) Collection. We host the Tree Register of Ireland at the Botanic Gardens, which falls under the Tree Council, a subset of these were formerly available on the Tree Council’s website.

Public Bodies are not required to submit a publication plan of environmental information to the Open Data Unit and none has been submitted.

Public bodies have published 3,542 datasets under the Environmental theme on the open data portal (https://data.gov.ie/dataset?theme=Environment). This is the only list of environmental data available for reuse to which the Open Data Unit has access.

In addition to this, I would like to emphasise that the Open Data Unit has no power to compel public bodies to release their data, nor does it have visibility of their data holdings, other than what is published on the open data portal.

The implementation of the Open Data Directive in relation to environmental data in Ireland

Under the AIE Regs to request the following:

AIE Request, 4/7/22

NPWS response on recording fires / vegetation burning

NPWS currently does not have centralised operational programs for recording of fires.

Vegetation burning if encountered through surveillance of Natura 2000 sites or targeted scientific monitoring, may* be reported as a pressure in section 4.3 “Threats, pressures and activities with impacts on the site” of the site EU report, called the Natura 2000 Standard Data Form.

These reports are available via the NPWS website by designation type and site code (‘Natura form’), e.g. https://www.npws.ie/protected-sites/sac/000407; https://www.npws.ie/sites/default/files/protected-sites/natura2000/NF000407.pdf) and are also accessible through the European Environment Agency’s EIONET Natura 2000 viewer https://natura2000.eea.europa.eu/#


NPWS targeted habitat and species monitoring programs may detect fires outside this network and these may* be reported as a pressure or threat in the monitoring publications which are also published to the NPWS website (https://www.npws.ie/publications, https://www.npws.ie/maps-and-data/habitat-and-species-data), as well as the Heritage Division web mapping portal of the Department of Housing, Local Government and Heritage: https://dahg.maps.arcgis.com/home/index.html and Data.gov.ie.

Work is ongoing to address a backlog of report data to publish as open access data through the NPWS website and data.gov.ie.
