Summary of Complaint Soil Association / Coillte (FSC Certification)

The complainant filed a complaint with ASI on September 8, 2021, about the responses from Soil Association Certification Limited, the Conformity Assessment Body (CAB), to two separate complaints that they had submitted to the CAB in June 2021. Both complaints involve a single felling site managed by Coillte Teoranta Irish Forestry Board, the Certificate Holder (CH) in the northwest of Ireland.

Complaint 1 was about if an ornithological assessment had been conducted prior to commencement of operations. This complaint asserted a “failure to carry out adequate pre-works ecological/ornithological assessment” for “an ecologically sensitive site”, and the absence of a plan to protect the ecologically sensitive area. Furthermore, they asserted that the Habitat Map for the licence did not show the adjacent Special Areas of Conservation (SAC). The complaint referred to the potential for disturbance of protected species during the period of breeding and rearing.

Complaint 2 was about breaches of standards and felling licence conditions during the felling and harvesting operations. The complainant provided documents and photos from the site.

For the purposes of this AIE please disregard any records published on LEAP Online

AIE: Field ecological surveys carried out by Coillte as part of licence applications which specifically included a bat survey/s

Case: OCE-153024-X8M1H3

Whether Coillte was justified in refusing access to information under article 7(5) of the AIE Regulations on the grounds that the requested information is not held by or for it

AIE request was for any field ecological surveys which included a bat survey, regardless of whether the bat survey was a standalone document or part of a larger ecological assessment.

AIE: Ballinalee Pig Farm, Longford

“Under the AIE Regs to request details of DAFM inspections at the following site: Ballinalee
Pig Farm, Longford Location: https://maps.app.goo.gl/g5ypRc6UH8dXE8kNA. Please include dates of inspections for 2023-2024. Please include inspectors’ reports, including any photographs, notes or other reports for the period 2023-24”

The initial decision maker has not included the Schedule of Records refused. Please forward the schedule so we can review and engage with the internal reviewer on each element For context, here’s the most recent EPA inspection file on the same pig farm, so RTK would expect that the DAFM inspection files might follow similar format
