Dear Sir/Madam,  

I refer to the request which you made dated 7 July 2023 under the European Communities (Access to Information on the Environment) Regulations 2007-2018. 

Your request sought:   24-02-2023 Longford County Council 2022 NEP Progress Reports   In response to your request, I wish to inform you that, in accordance with Article 7 of the European Communities (Access to Information on the Environment) Regulations 2007-2018, I have today decided to refuse access to the records requested.  

The 2022 NEP Progress Report is currently not publicly available at this time as it has been submitted to the EPA who are currently in the process of reviewing all 2022 Returns.  During this review process, the EPA can ask for changes to be made to a submission if the process has not been completed to their satisfaction. 

The report you request is in draft form and I am therefore refusing access to the record in accordance with Article 9(2)c   9. (2) A public authority may refuse to make environmental information available where the request— (c) concerns material in the course of completion, or unfinished documents or data,10. (6) Where a request is refused pursuant to article 9(2)(c) because it concerns material in the course of completion, the public authority shall inform the applicant of the name of the authority preparing the material and the estimated time needed for completion.  

In accordance with Article 10(6) please note that we expect that the EPA will be publishing all NEP Reports for 2022 on their website towards the end of 2023.    

Public Interest Test   Furthermore, in accordance with Article 10(3) and 10(4) I have weighed the public interest served by disclosure against the interest served by refusal of the 2022 NEP Report.   Factors in favour of release

  • The public interest in individuals being able to exercise their rights under the AIE Regulations to the greatest extent possible in order to access environmental information; and
  • The public interest in environmental information being made available and disseminated to the public in order to achieve the widest possible systematic availability and dissemination to the public of environmental information.

  Factors in favour of refusing access

  • The public interest in ensuring that information is not released under the AIE regime that would be misleading and provide an inaccurate picture on the environment and the environmental work of local authorities.

  I have determined that the public interest would not be served by disclosing the 2022 NEP Report.   Right of review Under Article 11 of the AIE Regulations you have a right to request an internal review of this decision.  An internal review involves a complete reconsideration of the matter by a member of the staff of Longford County Council, unconnected with the original decision, of the same or higher rank than the original decision-maker, who may affirm, vary or annul the original decision.

Complaints system in Carlow CoCo

Note: Investigation of complaints in 2022 has resulted in issue of various notices and warnings as well as legal prosecutions which is detailed in the RMCEI Data Return Template 2022 submitted with this Report.

WATER – Pressures from Agriculture (slurry/soiled water collection and storage)

7 inspections were conducted in 2022. Serious problems were found in 3 farmyards resulting in warning letters being issued to 3 farmers

Biosolids / fertilizer spreading

The three primary sources of sludge being spread in Carlow are from [REDACTED]. These supply sludge into County Carlow primarily from the Counties Kildare, Laois, Kilkenny and Dublin.

Approval was granted for the 52 farmers to spread 14,046 tonnes of biosolids from 4 different sources.

Priority was given to the spreading of biosolids in this, a strong, tillage County

Septic tanks

17 full septic tank inspections were completed in County Carlow in 2022

Section 4 trade effluent discharge licences

Water Framework Directive Monitoring

Analysis of results showed continuing high levels of Nitrogen in the at-risk water bodies, indicating the principle source of pollution in County Carlow is from agriculture. This is not surprising considering the high level of tillage land and the small number of septic tank failures.

Planning applications for agricultural development submitted in 2022 in Cork

114 farms which were determined to be high risk following inspection in 2021 were followed up in 2022 to ensure compliance with the GAP Regs

Inspections were carried out on 15 farms which were cross reported from DAFM to CCC in 2022.

CCC investigated 158 complaints regarding pollution from agriculture in 2022 . 72 warning letters were issued in response to these complaints.

An assessment of whether there is adequate slurry/soiled water storage capacity is carried out at all on-farm inspections.

CCC investigated 34 complaints regarding slurry & fertilizer spreading during the closed period in 2022

59 of the 113 systems inspected in 2022 failed the inspection, (52% non-compliance)

Section 4 trade effluent discharge licence inspections in Limerick

One S4 enforcement file dating from 2018 was closed after 12 Court Appearances.
One licence was reviewed.
One new licence was issued
Two licences ceased to have effect has the development was connected to a public scheme

21 cross-compliance reports were forwarded to DAFM for significant breaches of the Good Agricultural Practice for Protection of Waters Regs

Pesticide exceedances were recorded in the River Deel and on the River Feale

Limerick County has about 600 high stocked derogation farms mainly in the dairy sector. In 2022, the WFD team inspected 50 of these farms.

68 inspections carried out in 2022 (68 full inspections/17 verification inspections) – 37% of full inspections were non-compliant

In 2022 Clare County Council tackled several longstanding and high environmental impact cases. A Wastewater treatment facility operating without a Licence (currently with the courts for Hearing) and a Waste Tyres site (Stockpile of waste tyres – removal after prosecution).

20 inspections in 2022 of farmyards to assess slurry/FYM/soiled water collection and storage facilities. Compliance with the GAP Regulations can be considered high, with 80% of inspected farmyards deemed compliant.

Septic Tanks

Clare County Council inspected 53 Domestic Wastewater Treatment Systems (DWWTS) during 2022. This represents a 130% increase in the number of inspections completed in 2021.

Private Water Supplies

There is one supply (XXXXXX) still on boil water notice due to public health risk, we are in communication with the operator of the supply to take remedial action.
